Residential care homes may collect a security deposit from residents. The Code of Practice under the Residential Care Homes (Elderly Persons) Ordinance (Cap. 459) does not set a cap on the deposit amount, but homes must comply with the following requirements when collecting and refunding deposits:
- Set out in writing -- before admission, the home must state the deposit amount, refund conditions and refund procedures in writing (in the admission agreement).
- Notice of fee adjustments -- before adjusting any fees, the home must give at least 30 days""� written notice.
To protect your own interests, proactively ask the home for its fee leaflet and admission agreement before admission, and keep copies for record.
